Individually identifiable health information in this system is subject to the Health Information Portability and Accountability Act of 1996 and the Department of Health and Human Services Privacy Rule in regard to that Act. This information may only be used and/or disclosed in strict conformance with authorized authorities. The healthcare quality organizations using this system are required to and will apply appropriate sanctions against individuals who fail to comply with its privacy policies and procedures.

The QualityNet Web site is designed with funding from Centers for Medicare & Medicaid Services for use by healthcare providers, Quality Improvement Organizations, and/or End Stage Renal Disease Networks. This User Agreement is designed to inform you about the practices regarding collection, use, and disclosure of information that you may have access to with the QualityNet site. Please be sure to read this entire User Agreement.
In order to ensure the integrity, security, and confidentiality of information maintained by QualityNet, and to permit appropriate disclosure and use of such data as permitted by law, the User enters into this Agreement with QualityNet to comply with the following specific paragraphs.
The User represents and warrants further that he/she shall not disclose, release, reveal, show, sell, rent, lease, loan, or otherwise grant access to their User ID and password to the QualityNet secure Web site to any individual(s). The User agrees to notify the QualityNet Help Desk should they suspect their User ID and password to be compromised, such that it should be deleted and a new User ID and password should be issued.
The User agrees to establish appropriate administrative, technical, and physical safeguards to protect the confidentiality of the information accessed through the QualityNet secure Web site and to prevent unauthorized use or access to it. The User agrees that no findings, files, or information derived from the use of the QualityNet Web site may be released to unauthorized individuals.
The User agrees that in the event QualityNet Security determines or has reasonable belief that the User has made any unauthorized disclosure(s), their access will be revoked. The User acknowledges that criminal, administrative, or civil penalties under the Privacy Act may apply if it is determined that the individual knowingly and willfully released the information under false pretenses.
By accepting this agreement, the User agrees to abide by all provisions set out in this Agreement for protection of the data and acknowledges having received notice of potential criminal, administrative, or civil penalties for violation of the terms of the Agreement. In addition, by using the QualityNet Web site, you agree with the terms of the User Agreement.
As the QualityNet Security Administrator for their organization, the User agrees to determine who from their organization should have access to the QualityNet secure Web site, what type of access they should have, and to keep the personal security information for those users private. In addition, the User agrees to notify the QualityNet Help Desk of any potential security breaches, and to terminate users in QualityNet who have left their organization or who no longer require access to the QualityNet secure Web site.
